End User License Agreement

This End User License Agreement (EULA) is between you and Firmtrack LLC. It covers the Firmtrack web application, any installable web app we provide, and their updates and accompanying documentation. It forms part of our Terms of Service.

1. Your license

While you have authorized access and comply with the Terms and this EULA, we grant you a limited, non-exclusive, non-transferable license to access and use Firmtrack for your own lawful account operations, within the features and limits made available to you. You may install the web app on devices you control. The software is licensed, not sold; this license does not transfer ownership of Firmtrack to you.

This license permits business use for your own operation. It does not permit selling access to Firmtrack, sharing your login, or offering our software as a service to others without our written agreement. Features, subscriptions, and supported integrations are available only as described in the product and the Terms.

2. Our software and third-party rights

Firmtrack and its licensors retain their rights in the software, original design, documentation, branding, and protectable selection and arrangement of our compiled information. We reserve rights not expressly granted. We do not claim ownership of your records, underlying facts, or another party’s trademarks or content.

Third-party and open-source components remain subject to their applicable licenses. Nothing in this EULA limits permissions those licenses grant or rights that applicable law does not allow us to restrict. Prop-firm, broker, platform, and data-provider agreements continue to apply independently.

3. Permitted use and restrictions

Except as expressly permitted by this EULA, our written agreement, an applicable third-party license, or non-waivable law, you may not:

  • Copy, modify, distribute, sublicense, rent, resell, or create derivative works of our software or protected content.
  • Reverse engineer, decompile, or disassemble our software to obtain its source code.
  • Scrape, bulk extract, resell, or redistribute our maintained rule compilation, or bypass access controls or usage limits.
  • Remove required copyright, trademark, attribution, or other proprietary notices.
  • Interfere with the service, access another person’s account without authorization, or submit unlawful or infringing material.

You may use the export and sharing features we provide for your own records and reports, subject to third-party rights and any required notices. These restrictions do not prohibit keeping copies of your own data or using facts you obtain independently.

4. Your content stays yours

You retain your rights in the trades, notes, imported records, messages, and other content you choose to submit. You must have the rights, permission, or other legal authority needed to submit that content and let us process it for the feature you use.

You grant Firmtrack a non-exclusive, royalty-free license to receive, store, copy, process, transmit, display, and adapt that content only as needed to provide the features you choose to use. Adaptations are limited to those purposes, such as syncing records, generating your reports, and answering requested assistant questions where those features are available. We may permit the service providers described in our privacy policy to process content on our behalf for those purposes. This license does not give us ownership or permission to sell your content or use it in our advertising.

This license lasts while we process your content for those purposes. After deletion, it continues only for retained copies as necessary under the retention, backup, and legal-obligation provisions of our Privacy Policy. It does not promise immediate deletion from every provider or backup.

5. Ending access

Your license ends when your authorized access ends under the Terms. You must then stop using the software except for any reading or export access we expressly continue to provide. Ending access does not transfer ownership of your content to us, and does not itself cancel a paid subscription; follow the cancellation process in the Terms.

Ownership provisions, restrictions protecting retained copies, and provisions intended to survive remain applicable after the license ends, subject to applicable law.

6. How this agreement fits with the Terms

The Terms govern eligibility, billing, cancellation, service changes, termination, financial and trading risks, warranties, liability, indemnification, and disputes. This EULA governs the software license and content permissions; if the two conflict on those subjects, this EULA controls. Mandatory legal rights and applicable third-party license permissions remain unaffected. Material changes follow the notice process in the Terms.

Firmtrack provides recordkeeping and analysis tools, not financial advice, and does not place, change, or cancel orders. This EULA does not expand any feature’s availability or authorize use that violates your agreements with a firm or platform.
